3.1 The President shall:
3.1.1 be the official representative of the KDSL or appoint a Director or Officer to be the official representative;
3.1.2 be a signing officer for the KDSL;
3.1.3 not be a director, officer, representative or official for any soccer club, soccer league, soccer organization or soccer team associated with the KDSL;
3.1.4 perform duties as described in the KDSL Constitution, By-Laws and regulations;
3.1.5 perform other duties as determined by the Board.
3.2 A Director shall:
3.2.1 attend all Board and membership meetings;
3.2.2 perform duties as described in the KDSL Constitution, By-Laws and regulation,
3.2.3 perform other duties as determined by the Board.
3.3 The Treasurer shall:
3.3.1 keep full, accurate and current records of all financial transactions in books or electronic accounting systems belonging to the KDSL;
3.3.2 deposit all monies and other valuables into an account, in the name of the KDSL, at a chartered bank, trust company or credit bureau;
3.3.3 dispense funds as approved by the Board;
3.3.4 be a signing officer for the KDSL;
3.3.5 store and maintain the original and/or copies of all receipts, disbursements, deposits, cheques, invoices, financial statements and any other financial records for the current fiscal year and the previous seven fiscal years;
3.3.6 represent the KDSL at any audit of the financial records as required by law or as approved the Board;
3.3.7 submit financial information to individuals or organizations as required by law, by agreement, or by the Board on behalf of the KDSL;
3.3.8 not invest, lend, loan, borrow or otherwise commit the assets or incur debt on behalf of the KDSL without consent of the Board;
3.3.9 report the financial position of the KDSL to the Board at all Board meetings;
3.3.10 submit to the Members at the annual general meeting financial statements that accurately reflect the financial position of the KDSL at the fiscal year end;
3.3.11 control and distribute banquet tickets;
3.3.12 attend all Board meetings and membership meetings;
3.3.13 perform duties as described in the KDSL Constitution, By-Laws and regulations;
3.3.14 perform other duties as determined by the Board.
3.4 The Secretary shall:
3.4.1 record the minutes of all membership meetings and maintain the corporate minute book;
3.4.2 provide a copy of the membership meeting minutes to be approved at a membership meeting to each Member before the membership meeting;
3.4.3 maintain and store copies of the approved minutes of the KDSL for seven years;
3.4.4 supply copies of the agenda to Members at membership meetings;
3.4.5 record the minutes of all Board meetings and provide copies of the previous Board meeting minutes to each Board member;
3.4.6 record the minutes of all league meetings and provide copies of the previous league meeting minutes to each team;
3.4.7 receive and inform the Board of correspondence to the KDSL;
3.4.8 direct the official correspondence from the KDSL;
3.4.9 control and distribute identification and game passes;
3.4.10 perform the duties as described in the KDSL Constitution, By-Laws and regulations;
3.4.11 perform other duties as determined by the Board.
3.5 THE SCHEDULER SHALL:
3.5.1 develop and maintain the schedule for all KDSL games;
3.5.2 appoint or arrange the appointment of referee officials for all KDSL games;
3.5.3 inform KDSL teams, the Board and other organizations associated with the KDSL of the schedule and schedule changes;
3.5.4 be the KDSL contact for municipal parks and recreation departments;
3.5.5 attend all Board and league meetings;
3.5.6 perform duties as described in the KDSL Constitution, By-Laws and regulations;
3.5.7 perform other duties as determined by the Board.
3.6 THE PUBLIC RELATIONS OFFICER SHALL:
3.6.1 be the spokesperson for the KDSL;
3.6.2 record and maintain game records;
3.6.3 calculate league statistics and report the statistics to the media, teams and the Board;
3.6.4 provide press releases and reports to the media illustrating KDSL events;
3.6.5 solicit sponsorship and donations from organizations and individuals for the KDSL;
3.6.6 attend all Board and league meetings;
3.6.7 perform duties as described in the KDSL Constitution, By-Laws and regulations;
3.6.8 perform other duties as determined by the Board.
3.7 Officers shall normally be appointed at the first Board meeting after the annual general meeting. The term of office of an Officer shall end upon the appointment of another individual to replace the Officer or when the President accepts the written resignation of the Officer. If an Officer position becomes vacant the Board shall appoint an individual to the position at the first Board meeting after the position becomes vacant.
BY-LAW 5 - ONTARIO SOCCER ASSOCIATION
5.1 The KDSL shall be registered with the Ontario Soccer Association, also known as the OSA.
5.2 The KDSL shall comply with the Constitution, By-Laws, rules and regulations of the OSA.
5.3 Referees appointed to officiate at KDSL games must be registered as a referee with the OSA.
BY-LAW 6 – LEAGUE
6.1 The KDSL shall have three divisions which shall be ranked as follows:
6.1.1 Premier Division;
6.1.2 First Division;
6.1.3 Second Division.
6.2 The Premier and First Divisions shall be registered with the OSA as district men's competitive leagues. The Second Division shall be registered with the OSA as a men's' recreational league.
6.3 The Premier Division shall have ten teams. The First and Second Divisions shall not have less than six teams or more than ten teams.
6.4 The first place team in a division shall have the opportunity to be promoted to the next higher division in the KDSL for the next season. The team finishing last in a division shall be relegated down to the next lower division in the KDSL if the team finishing first in the next lower division is promoted to the next higher division.
6.5 If the team finishing first in the First Division is promoted to the Premier Division, the second place team in the First Division shall play a game with the ninth place team in the Premier Division to determine which team shall advance or remain in the Premier Division. The game shall be played after the end of the regular league schedule at a date, time and location as determined by the Scheduler. The game must be played before the annual general meeting. The team who wins the game shall be in the Premier Division for the following season. The team who loses the game shall be in the First Division for the following season. The game shall be considered a play-off game.
6.6 If the first place team in the First Division is not promoted, the second place team in the First Division shall have the opportunity to be promoted to the Premier Division for the next season. If the second place team chooses to be promoted, the team finishing last in the Premier Division shall be relegated down to the First Division.
6.7 The Board may offer an applicant the opportunity to join the First Division by majority vote at a Board meeting.
6.7.1 If there are ten teams in the First Division, and;
6.7.1.1 the tenth place team has been relegated down to the Second Division, the applicant shall play a game with the team that finished ninth in the First Division.
6.7.1.2 the tenth place team has not been relegated down to the Second Division, the applicant shall play a game with the team that finished tenth in the First Division.
6.7.2 The game shall be played after the end of the regular league schedule at a date, time and location as determined by the Scheduler. The game must be played before the annual general meeting. The team who wins the game shall be in the First Division for the following season. The team who loses the game shall be relegated to the Second Division for the following season. The game shall be considered a play-off game.
6.8 The Board shall determine the method to add teams to the Premier and First Divisions if they have less than ten teams.
6.9 A club may not have more than one team in a competitive division.
6.10 A team may choose not to be promoted.
6.11 The last two teams in the lowest division of the KDSL may be asked to reapply to the KDSL at the discretion of the Board.
BY-LAW 7 - TEAM APPLICATION
7.1 A team wishing to join the KDSL that is not registered with the KDSL must apply to the Secretary and shall herein and sometimes referred to as an applicant.
7.2 The applicant shall pay an application fee ($25.00) to the KDSL. The application fee must be paid when the team applies to the KDSL. Teams that are accepted into the KDSL must pay a one time Fee of $1000.00 to the Kitchener and District Soccer League, NON REFUNDABLE.
7.3 The Secretary shall provide the applicant with a current copy of the KDSL Constitution, By-Laws, regulations and a KDSL application form.
7.4 The application form must include a statement that the applicant has read and will comply with the KDSL Constitution, By-Laws, and regulations as a condition of joining the league. A team official must sign the application form to acknowledge that the applicant agrees to the conditions of their application to the KDSL and to verify the accuracy of the information on the application form.
7.5 The applicant shall deliver to the Secretary before October 15 th the completed application form and a certified cheque, cash or money order for all registration fees and bonds that will become due upon their acceptance into the KDSL. The Secretary shall not accept any application form that is: incomplete; not signed by the team official; or is not accompanied by a certified cheque, cash or money order for the total amount that will be due upon acceptance by the KDSL.
7.6 The Secretary shall inform the Board of the team name and the team official for all applicants.
7.7 The Board shall recommend to the Members teams that are to be considered to join the KDSL in a competitive division.
7.8 The teams shall accept applicants into recreational divisions at a league meeting. Usually at the first league meeting after the annual general meeting.
BY-LAW 8 – REGISTRATION FEES AND BONDS
8.1 Each team registered in a competitive division shall pay a registration fee of $600.00 to the KDSL.
8.2 Each team registered in a recreational division shall pay a registration fee of $400.00 to the KDSL.
8.3 All teams shall pay a bond of $500.00 to the KDSL. The bond shall be returned to the team upon confirmation :
8.3.1 by the Scheduler, that all league and tournament games are complete; and
8.3.2 by the Treasurer, that the team has no outstanding financial obligations to the KDSL; and
8.3.3 by the President, that if the team is a Member of the KDSL, the Member has attended the annual general meeting for the current season; and
8.3.4 that the KDSL has received the resignation of the team, in writing, as a team in the KDSL.
8.4 Members that have paid a behaviour bond to the KDSL and have been found guilty of misconduct by the KDSL shall forfeit the behaviour bond to the KDSL. The Member shall pay another behaviour bond to the KDSL that shall be held by the KDSL as described above.
8.5 The Board may request that a team that has been found guilty of misconduct pay an additional bond of $500.00 at its discretion. The bond shall be returned to the team at the end of the next annual general meeting provided that the team has not been found guilty of misconduct after paying the additional bond.
8.6 Teams who cease to be teams of the KDSL forfeit all bonds and all fees paid to the KDSL, except as otherwise described in the Constitution and By-Laws.
8.7 Registration fees and bonds shall be paid before the beginning of the first league meeting held after an annual general meeting. Teams who fail to resign, in writing, and do not pay the appropriate registration fee before the beginning of the first league meeting will be considered to have resigned from the KDSL and shall forfeit all bonds paid to the KDSL.
BY-LAW 9 – LEAGUE MEETINGS
9.1 Each KDSL team shall have one vote at league meetings.
9.2 Teams who are indebted to the KDSL must meet their obligations by October 31 st or cease to be team with the KDSL.
9.3 Each team must appoint an individual as a representative. Teams must inform the Secretary, in writing, of their representative at the first league meeting after an annual general meeting.
9.4 The team representative shall vote on behalf of a team at a league meeting.
9.5 An individual may be the team representative for more than one team provided that all teams the individual represents are registered with the same club. An individual may not have more than one vote at a league meeting even though the individual may be the representative for more than one team.
9.6 If the team representative is not able to attend a league meeting the team may appoint an alternate to represent the team. The alternate must inform the Secretary before the league meeting that they are representing the team. The alternate may not vote at the league meeting.
9.7 The Board shall call a league meeting by majority vote. The Board shall establish the date; time and location of league meetings. Teams shall be notified of the date, time and location of a league meeting at least seven days before the membership meeting.
9.8 The President shall chair or appoint the chair of a league meeting.
9.9 The chair shall determine the agenda for a league meeting.
9.10 Teams indebted to the KDSL must meet their obligations before a league meeting or shall not be eligible to vote or attend the league meeting.
9.11 Quorum for a league meeting shall be one half the number of teams.
9.12 Decisions shall be by simple majority of teams present at the league meeting. Proxy votes are not permitted.
9.13 Voting shall be by show of hands. If the result of a vote is questioned the chair shall record the preference of each team verbally and declare the results of the vote.
9.14 The chair shall have the deciding vote if the vote is tied.
BY-LAW 10 – REGULATIONS
10.1 The Board shall amend the regulations of the KDSL at a board meeting by majority vote.
10.2 Amendments to the regulations made between May 1 st and September 30 th must not become effective for at least thirty days from the day the Board voted to amend the regulation. Amendments to the regulations must be sent to all teams within seven days of being accepted by the Board by regular mail.
10.3 The regulations must conform to the Constitution and By-Laws.
10.4 Each team shall receive a copy of the current regulations at the first league meeting held after May 1 st .
REGULATION 1 - LEAGUE RULES
1.1 All games shall be played in accordance with the Laws of the Game as established by the Fédération Internationale de Football Association (FIFA).
1.2 Each team shall be permitted seven substitute players for a game. Teams are permitted an unlimited number of substitutions during a game.
1.3 If a team is not prepared to begin a game after a grace period of thirty minutes after the scheduled start time, the team shall be considered to have abandoned the game. The team that is prepared to play the game may extend the grace period at its discretion.
1.4 Games will be considered complete if the referee abandons the game and at least twenty-minutes of the second half of the game has been played. If less than twenty minutes of the second half has been played the game shall be rescheduled.
1.5 If either team requests to view a player's registration book before a game, the players for both teams shall line up and the officials from each team shall assist the officials from the other team to view the player books. The referee shall not start the game until the officials for each team have had an opportunity to view the player book for each player listed on the team sheet.
1.6 Each team shall be allowed a Coach, Assistant Coach, Manager, and Trainer as team officials. The team must inform the Secretary, in writing, of the name for each of the Coach, Assistant Coach, Manager and Trainer. Only players and team officials listed on the team sheet are permitted in the team bench area during a game.
1.7 Each home team must provide a minimum of two marshals at every game. (Discretion of the Referee) The marshals shall:
1.7.1 protect the referees;
1.7.2 protect the officials and players;
1.7.3 ensure spectators are kept away from the player benches;
1.7.4 ensure spectators are kept away from behind the goal areas; and
1.7.5 follow instructions from the referee.
1.8 Each team shall deliver to the referee the team sheet for the game before the kick-off for the first half of the game. The team sheet must have the name of each player, the player's number, and each team official that participates in the game . Players may be added to the team sheet during the first half of the game provided that the opposing team is given an opportunity to view the player's registration book. A player's name or number may not be changed or removed from the team sheet without notifying the referee.
1.9 Only team sheets issued by the KDSL shall be used as team sheets.
1.10 The team sheet shall be the official record of the game result. In the event that there are different versions of a team sheet, the Public Relations Officer shall determine the team sheet that will be recorded as the game result.
1.11 If a referee fails to report for a game, the teams may appoint a substitute referee provided that both teams agree. The substitute referee shall be considered the official referee for the game and shall earn the appropriate fee.
REGULATION 2 – LEAGUE STANDINGS
2.1 A team shall earn three points for winning a game, one point for tying a game and zero points for losing a game. The number of points earned shall determine a team's standing in the league.
2.2 If more than one team has an equal number of points, the following criteria, in order, shall be used to determine a team's standing.
2.2.1 The goal difference defined as the total goals scored less the total goals allowed.
2.2.2 The total number of goals scored.
2.2.3 The goal difference from the matches played between the teams that are equal in points.
2.2.4 A toss of a coin by a person appointed by the Board.
2.3 If a team causes a game to be abandoned, the team shall be recorded as losing the game and the team shall have an additional three points deducted from the team's standings. The score when the game was abandoned shall be recorded provided the team that did not cause the game to be abandoned has the most goals. If the team who caused the game to be abandoned has the most goals, the score shall be recorded as a 3-0 win for the other team.
2.4 If a team plays an ineligible player, the team shall be recorded as losing the game and the team shall have an additional three points deducted from the team's standings. The score for the game that the ineligible player played shall be recorded provided the team that did not play the ineligible player has the most goals. If the team who played the ineligible player has the most goals, the score shall be recorded as a 3-0 win for the other team.
2.5 If a team declines to play a KDSL game the team shall have three points deducted from its league standing. The President may make an exception for special circumstances.
2.6 The Board shall determine the score for a game where the game result is changed by an organization associated with the KDSL.
2.7 If a team ceases to be a team in the KDSL all league games in which the team participated shall be considered null and void.
2.8 Teams are not permitted to participate in other leagues without written permission from the President.
2.9 The home team must provide dressing facilities and showers reasonably adjacent to the playing field. The Board may approve playing fields without dressing facilities or showers.
REGULATION 3 - LEAGUE SCHEDULES
3.1 A draw to determine the team number for each division shall be held at the first league meeting after the annual general meeting.
3.2 A league schedule with one game scheduled per week, which shall include the team number and whether the team is the home or away team will be given to each team before the draw.
3.3 For the purpose of the schedule a week shall start on Monday and end on Sunday.
3.4 Teams shall schedule their own home games during the week indicated on the schedule.
3.5 Teams must inform the Scheduler, in writing, of the date, time and field location for all home games no later than February meeting .
3.6 The Scheduler shall provide a preliminary schedule to all teams no later than March meeting.
3.7 Teams shall have an opportunity to change scheduled game dates, times and fields, provided that both teams involved agree. The Scheduler must be informed, in writing, of all schedule changes before March 31 st . Teams may not change the schedule, after schedule is printed to a hard copy, without paying the appropriate fee ( $200.00 ) for rescheduling a game.
REGULATION 4 - LEAGUE FEES
4.1 Teams listed as the home team who do not provide two soccer balls for use in a game shall pay a fee of $50.00 to the KDSL.
4.2 Teams who begin a game with less than eleven players shall:
4.2.1 pay a fee of $ 15.00 to the KDSL if the team has ten players; or
4.2.2 pay a fee of $ 45.00 to the KDSL if the team has nine players; or
4.2.3 pay a fee of $ 90.00 to the KDSL if the team has eight players; or
4.2.4 pay a fee of $150.00 to the KDSL if the team has seven players.
4.3 Teams who cause a game to be abandoned shall pay a fee of $250.00 to the KDSL and shall pay the opposing team a fee equal to all expenses incurred by the opposing team for the game. Expenses incurred by the opposing team are subject to approval by the Board.
4.4 Teams listed as the home team who do not report game results to the Public Relations Officer no more then 1 hr after the game has been completed on the day the game is played shall pay a fee of $50.00 to the KDSL. The Public Relations Officer shall determine the date and time the game results are received.
4.5 If a game is rescheduled the team requesting the game to be rescheduled shall pay a fee of $200.00 to the KDSL.
4.6 Teams responsible for paying referees whom do not pay the referees before or immediately following the game shall pay a fee of $100.00 to the KDSL.
4.7 Teams who do not return trophies belonging to the KDSL to the Public Relations Officer on or before February meeting shall pay a fee of $100.00 to the KDSL.
4.8 A team must register a minimum of eleven players with the OSA at least seven days before the first scheduled game of the season. Teams who fail to register a minimum of eleven players shall pay a fee of $25.00 to the KDSL for each player the team is under the minimum.
4.9 Members who do not have a delegate attend a membership meeting (A.G.M) shall pay a fee of $100.00 to the KDSL.
4.10 Teams who do not have representation at a league meeting shall pay a fee of $50.00 to the KDSL.
4.11 If a Member's delegate is not present when the chair calls a membership meeting to order or a team's representative or alternate is not present when the chair calls a league meeting to order shall pay a fee of $50.00 to the KDSL.
4.12 Teams who change their representative or alternate member after April meeting and for the current season shall pay a fee of $100.00 to the KDSL.
4.13 If the KDSL rents a field on behalf of a team, the team must pay to the KDSL the cost of the field rental before the end of the month the field was rented.
4.14 If the KDSL pays outstanding debts on behalf of a team, the team shall pay a fee of $100.00 in addition to reimbursing the KDSL for the debt.
4.15 Teams shall pay a fee of $50.00 to the KDSL for each cheque issued to the KDSL that is returned due to insufficient funds. Second NSF fee is $100.00, Third NSF, member looses the BOND.
4.16 Teams who do not pay fees when due shall pay a fee of $100.00 in addition to the amount owed to the KDSL.
4.17 The fee for a team to protest a game shall be $200.00 payable to the KDSL by certified cheque, cash, or money order. The cheque, cash or money order must be paid when the protest is submitted to the KDSL.
4.18 Each club must purchase ten banquet tickets for the KDSL banquet on or before the September meeting. The cost for tickets is $300.00 (PER CLUB)
REGULATION 5 - GAME ADMISSION
5.1 Teams shall honour game passes issued by the KDSL and any other game passes approved by the Board.
5.2 Passes allowing free admission to any KDSL game shall be issued to:
5.2.1 All KDSL Board members;
5.2.2 KDSL Member representatives;
5.2.3 Team officials for each Member team, and;
5.2.4 any other person as determined by the Secretary.
5.3 Referees registered with the OSA shall be eligible to attend any KDSL game free of charge. The referee must show their current OSA identification at each game if they wish to attend free of charge.
5.4 The home team shall provide the opposing team with twenty free admission passes for each game.
5.5 Game admission prices Members may charge shall be $3.00 for adults, $1.00 for children twelve years of age or younger, and $1.00 for seniors sixty-five years of age or older. Players who present a KDSL Special Player Pass shall pay $1.00 for all KDSL games, except cup and play-off tournament final games.
REGULATION 6 - POSTPONED AND RESCHEDULED GAMES
5.1 All postponed or rescheduled games must be played within seven days of the scheduled game date.
5.2 Games will be rescheduled if a team is participating in an Ontario Cup game within seven days of the scheduled start time of the game. The Scheduler shall determine the date and time for the game to be rescheduled.
5.3 Teams may request the Scheduler to reschedule a game if:
5.3.1 both teams agree to the date, time and location of the rescheduled game; and
5.3.2 the Scheduler has been informed in writing of the date, time and location of the rescheduled game at least ten days before the date of the scheduled game and rescheduled game; and
5.3.3 the Scheduler has determined that a referee and assistant referees are available to officiate at the rescheduled game . With an appropriate fee of ($200.00)
REGULATION 7 - PROTESTS AND APPEALS
6.1 Game protests and complaints must be made in writing and be hand delivered or delivered by registered mail to the Secretary. KDSL game protests must be received by the Secretary within three business days of the game date and must be accompanied by the appropriate fee of $200.00.
6.2 Copies of game protests delivered to the Secretary must be delivered by registered mail to all teams and persons named in the protest within three business days of the game date.
6.3 A Canada Post receipt verifying each registered letter mailed to teams or persons named in protest must be delivered to the Secretary within three days from the date the registered letter was sent.
6.4 The Board shall respond to all protests and complaints on behalf of the KDSL. The Board must respond to all protests, in writing, within fifteen days of receiving the protest. The decision of the Board shall be considered final and may not be overruled by the Members.
REGULATON 8 - PLAY-OFF AND CUP TOURNAMENTS
7.1 KDSL rules shall apply to all play-off and cup tournaments, except as noted in these By-Laws.
7.2 Players must have been registered as a player with a Club for at least five league games during the current season to be eligible to play in a play-off or cup tournament.
7.3 Players shall not be registered for more than one KDSL team participating in a KDSL tournament.
7.4 Tournament games may be rescheduled only at the discretion of the President.
7.5 If a tournament game is tied at the end of the game, the game shall be decided by penalty kicks .
7.6 The Board shall determine the draw for all cup tournaments.
7.7 The Board shall determine the date and location for all final tournament games.
7.8 The net profit (revenues less expenses) for all cup and play-off tournament games, except the final games, shall be divided equally between both teams participating in the game. The net profit for all final cup and play-off tournament games shall be divided with both teams participating in the game.
7.9 A team who abandons or forfeits a cup or play-off game shall be eliminated from the tournament.
Fine of $100.00 will apply
REGULATION 9 – TROPHIES
8.1 Teams who receive trophies from the KDSL that are the property of the KDSL must ensure the trophies are not damaged or harmed in any way.
8.2 Teams must return trophies belonging to the KDSL at the first league meeting in February. The team is responsible for cleaning the trophy before returning the trophy to the KDSL.
8.3 Trophies returned to the KDSL that are damaged or require cleaning shall be repaired or cleaned by the KDSL and the team shall reimburse the KDSL for all repair or cleaning costs. The Public Relations Officer shall determine if trophies are returned damaged or require cleaning.
